OK YACHTS may modify parts of this Privacy Notice over time, so please check its content periodically. In the event that we make a modification that materially affects your rights or, to the extent we are authorized to do so, make significant changes to how we use your personal information, we will notify you by prominently posting it on our websites, by email, and/or postal mail before the change takes effect.

This Privacy Notice covers the personal information that OK YACHTS companies collect, use, and disclose  when you use their products and services, both online and physically.

  1.  OK YACHTS needs to collect your personal information in order to:
  • Rent a boat or provide you with any other of the services we offer.
  • OK YACHTS collects personal information when you provide it to us, such as by telephone, fax, post, email, at the counter, when you complete an application or registration form, when you join our loyalty scheme, or when you use an OK YACHTS  website or mobile applications or when you use our products and services.

If you do not provide us with the personal information we are requesting, we will not be able to provide you with the required service. In such a case, you will be informed of this situation and what the consequences will be if you do not provide your personal information. We must also retain the information you provide to us in order to comply with all legal obligations of OK YACHTS companies.

Sometimes we will combine the personal information you provide with other information we receive from other sources and/or third parties. This information may include any information that is relevant for the purposes of your booking. These third parties may include:

  • Travel agencies or third-party booking services that you use when making your booking;
  • Your company or association in the event that you are using a company/association account;
  • Our licensees and affiliates, for the purpose of creating a preferred account or if you are making a reservation at a rental service establishment serviced by our affiliates or licensees at another establishment serviced by us; and
  • Police and other law enforcement if you are involved in an accident during your rental or suffer a loss, damage or theft of the boat or if you are given a ticket for speeding, bad parking, toll or any other traffic ticket or commit a traffic violation during your rental.

The current data protection regulation includes different cases under which OK YACHTS may use your personal information for these purposes:

  1. That you have consented to the use of your personal information for this purpose (for example, where you have consented to us sending you electronic communications);
  2. We need to use such personal information to fulfil our contract to provide products and services with you (for example, by using your information for boat hire or to incorporate you into our loyalty programme
  3. That the processing of the data is necessary for the exercise of our legitimate interests.
  4. When we need to comply with a legal obligation (for example, responding to government or law enforcement requests for information).

Our legitimate interests are:

A. Ensure the effective administration and management of your relationship with us, including any rentals and/or purchase and sale of vessels you make with us;

B. Understand how customers use our services and how to manage our fleet of vessels;

C. Conduct research and analysis about the services or products our customers want or how we would like to improve our products and services;

D. Understand how customers use our websites and apps and detect any issues that arise in relation to how the websites and apps are used and how we can improve our customers' user experience;

E. Inform our customers about the different products and services we can offer;

F. Understand and respond to our customers' comments and observations;

G. Improve the tailoring and personalization of the promotions and benefits we offer to our customers;

H. Prevent, detect, or investigate unauthorized use of our vessels and systems and ensure our compliance with laws and policies; and

I. To manage any disputes and accidents and to receive legal or professional advice.

DETAILS OF THE PROCESS OF RENTING A BOAT

When you make a reservation, rent a boat, or join one of our programs, such as a corporate program or our loyalty program, we collect information to provide you with our services. The information we collect includes:

  • The name;
  • The email address (if you are booking online or would like to receive electronic receipts);
  • Personal address (to verify the skipper's card and billing details);
  • Company details and registered office (if you are a member of a corporate program);
  • The telephone numbers where we can reach you;
  • Date of birth (to verify the skipper's card and compliance with legal requirements);
  • Gender (to verify driver's license)
  • Payment information, such as your credit or debit card details (the security code is obtained only for the purpose of the transaction, it is not stored by us);
  • Tax identification number (if expressly requested);
  • Employer card information and/or any other government-issued identification document
  • Special discount codes, membership numbers, participation in associations, corporate rewards programs (if you apply for special discounts, special privileges, and points programs);
  • Special Requests and Preferences, Including:
  • Your preferences for optional extras such as loss or damage waivers and other protections;
  • Where a pick-up or drop-off service is available, the address where the boat will be dropped off or picked up and any optional extras requested; and
  • Any other information that may be necessary to rent a boat and/or provide services to you.

During your rental we will collect data relating to where and when you have rented the boat, where and when you have returned the boat, your insurance coverage preferences, fuel consumption and any other information relating to the boat being used by the boat. This information is requested to provide you with the services contracted under the rental agreement or to defend our legitimate business interests.

In addition to the above-mentioned purposes, we will use this information to better understand our customers and provide you with the most appropriate offers for your profile.

When you call us (from any phone), we may record or monitor the call for quality control, training or similar reasons.

OK YACHTS LOYALTY PROGRAM

In the event that you choose to join our loyalty program, we will collect and, in order to create an account in our program for you in accordance with the terms and conditions stipulated in the program itself, we will retain the following information:

  1. Your first and last name
  2. Email
  3. Contact details,
  4. Date of birth.

We will use this information, along with information regarding your past and future rentals, so that you can take advantage of the benefits of being a member of the loyalty program and offer you more benefits to which you are entitled under the program, such as discounts, free upgrades, and other benefits.

We will also use this information to personalize the communications we may send you and/or the promotions we may offer you over time as a member of the loyalty program. We will also use this information for our internal analysis of how customers use our services and to improve the delivery of our services.

ONLINE DATA

OK YACHTS automatically collects technical information when you download, visit or use our websites and/or applications from any of the Group companies. This section tells you more broadly about the technical information we collect and why we do it.

  • IP addresses and other information collected automatically: We may collect your IP address when you visit our websites to help us diagnose problems with our home computers, administer systems, provide aggregate information to our business partners, and to audit the use of our website. We do not normally link IP addresses to any personally identifiable data. In certain specific circumstances, we may use IP addresses to identify you when we believe it is necessary to enforce the terms and conditions of our website or to protect our service, site, users, or other third parties. We may also collect your browser type, Internet Service Provider (ISP), referring/exit pages, files viewed on our site (such as HTML pages, graphics, etc.), operating system, date/time stamp, and/or clickstream history to analyze aggregate trends and administer the site.
  • Session replay: When you visit our website, we will also sometimes record information about your browsing session on the site, including the pages you visit and the website forms you have filled in. We will study this information to detect any technical problems that occur in the operation of our sites and to improve their user interface. We will use the services of a third party to assist us with this service and this information will be passed on to this third party for such purposes, although it will not be disclosed to any other third party.

  • Mobile Analytics: When you download and use our Apps, we will use mobile analytics software to help us better understand the functionality of our App on your mobile device. Our analytics may record how often you use the App, how you use it, aggregate usage, performance data, and where you downloaded the App from. Please see the Analytics section to learn more about how we use information for analytics.
  • Mobile GPS and Push Notifications: When you use our OK YACHTS  Apps we may collect location markers using your device's GPS, provided you give us your consent. Knowing where you are approximately helps the App to offer you a better service, such as, for example, finding the nearest OK YACHTS  rental office or points that may be of interest to you. It also helps us to send you push notifications or other communications based on your location (such as special offers in the vicinity) and to provide certain services such as arrival and return notifications, providing information about the location of the boat, available upgrades, etc. We will only share this information with our mapping provider for the purpose of providing our services to you. To ensure that you receive appropriate notifications, we will need to collect certain information about your device, such as your operating system and user identification information. In the event that you change your mind about sharing your location or receiving push notifications from the App, please change the settings on your mobile device to turn off the transmission of geolocation data or to stop the transmission of push notifications at any time. Just remember that if you turn off these features, you will not receive personalized information based on your location or location-based special offers.

MARKETING & ANALYTICS

OK YACHTS may share personal information with OK YACHTS to help us with our marketing and promotional projects, such as managing our social media pages, running contests, sweepstakes and other promotions, or sending marketing communications.

We will only use your personal information to send you marketing where you have given us permission to receive marketing or where we are authorised to do so in accordance with applicable law. This marketing will be sent to you via email, SMS, push notifications, or to your mailing address.

In the event that you do not wish to receive post, promotional and marketing emails and text messages from OK YACHTS , our partners may, at any time, withdraw your consent to direct marketing or tell us that you do not wish to receive further commercial communications.

We also use analytics software, such as Adobe Analytics, Google Analytics, and others, to help us better understand the functionality of our software on our websites and Apps on your device. These software tools record technical information including, but not limited to, information about your device along with usage information such as how often you use our website or app, the features you use or do not use on the website, or which pages you visit on the website, aggregate usage, performance data, when the App was downloaded, and information about your visit to the site, including details about the history of clicks made on a Uniform Resource Locator (URL) to, through, and from our website. In addition, in the event that we are defending a legal claim, we may disclose to third parties information about you that is relevant to that claim, as a result of or in connection with associated legal proceedings.

As set out in the Marketing section, we may share your information with business and promotional partners (where you have given us your consent to share such information) to send you information about products and services you may like. INTERNATIONAL TRANSFERS

Rentals

Because we offer the ability to rent boats and benefit from the services we offer in many locations around the world, we will transfer your personal information to our affiliates, independent licensees and travel agencies in these locations for the purpose of fulfilling your rental request and/or entering into a rental agreement. The exact location where your personal data will be transferred will depend on where you are renting. A list of these places can be found on our website https://okyachts.com.

These transfers are made to the extent that they are necessary for the performance of a contract to which you are a party or as pre-contractual measures. Alternatively, the adequacy of data protection is ensured by entering standard data protection clauses with the respective recipient.

The United States does not have a decision issued by the European Union Commission regarding the protection afforded to personal information. On the other hand, the adequacy of data protection is guaranteed by standard data protection clauses that we have established with these third parties. Given the global nature of our business, we also transfer information within OK YACHTS group companies, as shared IT functions are used for certain group activities.

YOUR PRIVACY RIGHTS

In accordance with applicable data protection legislation, you have the following rights with respect to the processing of your personal information:

  • Right of access – you have the right to request a copy of the personal information we hold about you and to request explanatory information about how your personal information is used.
  • Right to rectification – you have the right to request that we rectify inaccurate personal information concerning you.
  • Right to erasure – you have the right to request that we erase personal information concerning you.
  • Right to restriction of processing – in some situations you have the right to request that we do not use the personal information you have provided (for example, if you believe it is inaccurate).
  • Right to data portability – you have the right to receive certain personal information from you in a structured, commonly used and machine-readable format and to transmit it to another controller.
  • Right to withdraw consent – where we process your personal information on the basis of consent (including direct marketing consents) you have the right to withdraw consent at any time. However, this will not affect the lawfulness of processing based on consent prior to its withdrawal. In addition, even in the event of a withdrawal, we may still use your personal information to the extent permitted or required by law.
