  1. How do we collect your personal data?

We collect data provided directly by the customer, either at the time of requesting the service through the completion of the forms provided for this purpose or those provided throughout the contractual relationship through different means, such as, for example, complaints or requests for information filed with the customer service. The Client is responsible for its veracity and up-to-date

When filling out a form on our website, you are obliged to fill in the fields marked with an * (asterisk). The consequence of not providing this data may be that we do not comply with certain obligations. Sometimes it is referred to partner or third-party websites. This is clearly indicated. The way in which these parties process your personal data is detailed in their privacy statements.

  1. Legitimacy for the use of your personal data.

We inform you that the processing of your data is legitimized by:

·       Your Consent.

·       The preparation or execution of a contract.

·       To comply with a legal obligation.

·       To protect your 'vital interests'.

·       Due to the need to process personal data to fulfil a task of general interest

·       Due to our 'legitimate interests' or those of the partners.

3.    Purposes and grounds for the processing of personal data

The processing of your data pursues the following purposes:

  • Purpose 1: Provision of the contractual service, the information you provide us with is processed in order to provide you with the requested service and to invoice it. The data provided will be kept for as long as the business relationship is maintained or for the years necessary to comply with legal and contractual obligations.
  • Purpose 2: To send advertising about new rates, promotions and offers from OK YACHTS or the rest of the brands linked to the OK YACHTS group of companies applicable to the contracted service or that are similar.
  • This purpose includes the use of your personal data to send you communications related to the provision, improvement and updating of services, as well as advertising information about promotions applicable to your Service or other services – including value-added services – that may be of interest to you.
  • Purpose 3: Development of commercial actions on products and services offered by other companies of the OK YACHTS group.
  • In the event that you give your consent, OK YACHTS may carry out commercial actions with the aim of sending you, through any channel, offers and promotions on other products and services of companies in the OK Group.
  • Purpose 4: Development of commercial actions on products and services offered by third parties belonging to the leisure, culture, insurance, financial services, tourism, health or automotive sectors.
  • In the event that you give your consent, OK YACHTS may carry out commercial actions for third parties with the aim of sending you, through any channel, offers and promotions from third parties in the leisure, culture, insurance, financial services, tourism, health or automotive sectors.
  • Purpose 5: Transfer of your data to companies of the OK YACHTS group.
  • In the event that you give your consent, OK YACHTS will transfer your data to the rest of the companies of the Group in order to: 1. Be able to share information and, through the study of the aggregated information, carry out statistical studies that allow commercial actions of greater value for both parties (e.g. identify in which offices you rent most frequently); 2. That the rest of the companies of the Group can contact you directly, through any communication channel, to develop commercial actions on their products or services.

4.    To whom do we disclose your data?

The personal data processed by OK YACHTS, in order to achieve the purposes detailed above, may be communicated to the following recipients:

  • State, regional and local public administrations, in compliance with legal obligations.
  • State security forces and bodies, in compliance with legal obligations.
  • Courts and Tribunals, in compliance with legal obligations.
  • Public Prosecutor's Office, in compliance with legal obligations.
  • Banks, in cases of financing, due to the execution of a contract.
  • To OK YACHTS companies, due to your consent

5.    Data retention period

Personal data will be kept for as long as the contractual relationship with the customer is maintained and after it, until you decide to notify us of its deletion or until it is legally necessary, if you have given your consent. Once the contractual relationship has ended and if you decide to notify us of its deletion, the data will be deleted in accordance with the provisions of the data protection regulations, which implies its blocking, being available only at the request of Judges and Courts, the Public Prosecutor's Office or the competent Public Administrations during the limitation period of the actions that may arise.

In any case, if at the end of the contractual relationship there are pending litigations arising from the exercise of actions to challenge the invoice or to achieve the collection of the same, the data may be kept during the processing of the same, until a final resolution is reached - the date on which it will be blocked and subsequently deleted. however, they may only be used for evidentiary purposes.

6.    Data protection and your rights

OK YACHTS informs that it will proceed to process the data in a lawful, fair, transparent, adequate, relevant, limited, exact and up-to-date manner. That is why OK YACHTS undertakes to take all reasonable measures to ensure that these are deleted or rectified without delay when they are inaccurate.

In accordance with the rights conferred on you by current data protection regulations, you may exercise your rights:

  • Right of access: Know what type of data we are processing and the characteristics of the processing we are carrying out.
  • Right to rectification: To be able to request the modification of your data because they are inaccurate or untruthful.
  • Right of portability: To be able to obtain a copy in an interoperable format of the data being processed.
  • Right to restriction of processing in the cases set out in the Law.
  • Right to erasure: Request the deletion of your data when the processing is no longer necessary.
  • Right to object: Request the cessation of the sending of commercial communications and the creation of profiles with direct marketing, in the terms indicated above.
  • The right to revoke the consent given, and your request will be processed within approximately 20 days.
