INTRODUCTION AND LEGAL DATA These General Conditions regulate the use of the okyachts.com website and the intermediation service for booking recreational vessels. This platform is owned by OK MOBILITY ESPAÑA S.L.U. with VAT ID B57334609 and registered office at Avda. Gran Via Asima, 36 A, 07009 Palma, Spain (hereinafter, "OK MOBILITY", "okyachts.com", or "the Platform"). Through the Platform, okyachts.com facilitates contact between the legal owner or manager of the vessel (hereinafter, "Owner") and the client interested in renting it (hereinafter, "Client" or "Charterer").

1. ROLE OF THE PLATFORM (INTERMEDIATION) okyachts.com is a digital Marketplace. We act exclusively as an intermediary agency (Information Society Service Provider). OK MOBILITY is not the owner, lessor, or operator of the vessels listed on the website. Our responsibility is strictly limited to facilitating the booking and processing online payments on behalf of the Owner.

2. THE CHARTER AGREEMENT By confirming a booking on okyachts.com, the Client accepts that the final service will be provided by a third party (the Owner). The legal rental contract (Charter Agreement) will be formalized and signed directly and exclusively between the Client and the Owner prior to boarding. okyachts.com is not a party to this contract and is fully exonerated from any civil, criminal, administrative, or maritime liability arising from navigation, the condition of the vessel, or conflicts between the parties.

3. BOOKING CONDITIONS AND ONLINE PAYMENTS okyachts.com manages the collection of the booking via a secure payment gateway on behalf of the Owner.

  • Booking Confirmation: The Client will pay 20% of the base price through the website at the time of the request.

  • Final Payment: The remaining 80% must be paid via our platform 7 days before the charter starts. If the booking is made less than 7 days in advance, 100% must be paid immediately. The booking is not valid until payment is complete. Once 100% is paid, the Platform will provide the Client with the Owner's direct contact details to organize boarding.

4. PAYMENTS AT THE BASE (EXCLUDED FROM THE WEB) The Client acknowledges that the following concepts are not paid on okyachts.com and must be paid directly to the Owner at the base port before departure:

  • APA (Advance Provisioning Allowance): Fund for fuel, provisions, and moorings outside the base port.

  • Security Deposit: Funds withheld and managed exclusively by the Owner to cover potential damages.

  • Extras and Ecotax: Skipper/cleaning fees (if not paid online) and the Sustainable Tourism Tax (Balearic Ecotax), the collection of which is the legal responsibility of the Owner.

5. CANCELLATION AND REFUND POLICY

  • Cancellation by the Client: If the Client cancels before the 7-day final payment is due, they will lose the initial 20%. If they cancel after paying 100%, the booking is non-refundable. okyachts.com will attempt to mediate to find alternative dates, subject to the Owner's approval.

  • Exception to the Right of Withdrawal: Pursuant to Art. 103.l of the Spanish Consumer Law, as this is a leisure service for a specific date, the 14-day right of withdrawal does not apply.

  • Cancellation due to Bad Weather: If the Skipper or Owner determines that weather conditions (winds > Force 6) prevent safe navigation, the following will be offered: 1st) Date change; 2nd) 1-year voucher; 3rd) Full refund.

  • Cancellation due to breakdown: If the Owner cancels due to technical reasons, okyachts.com will process a 100% refund to the Client.

6. OPERATIONAL CONDITIONS REQUIRED BY THE OWNER By booking through okyachts.com, the Client agrees to comply with the standard operational rules required by Owners for the delivery of the vessel:

  • Licenses: For bareboat charters, it is the Client's responsibility to physically present the original and valid nautical license to the Owner. Lack of a license will result in the Owner denying boarding with no right to a refund.

  • Check-in / Check-out: The Client commits to returning the vessel to the Owner at the agreed time and in the same condition (with a full tank, if stipulated). The Owner reserves the right to deduct penalties from the Deposit for delays, damages, extreme cleaning, or missing fuel.

  • Onboard Rules: The Client commits to the Owner not to exceed maximum capacity, not to sublet, not to bring illegal substances, to supervise minors, and to obey maritime authority rules.

7. PLATFORM LIABILITY EXEMPTION okyachts.com assumes no liability arising from:

  • The condition, maintenance, cleanliness, or breakdowns of the chartered vessel.

  • Accidents, injuries, property damage, or loss of personal effects during the charter.

  • The management, retention, or return of the Security Deposit, which is strictly a matter between the Client and the Owner.

  • The lack of truthfulness in the information provided by the Owner in their listing.

8. GOVERNING LAW, JURISDICTION, AND PRIVACY These intermediation conditions are governed by Spanish law. Any dispute related to the use of the okyachts.com Platform shall be submitted to the courts of Palma de Mallorca. Disputes arising from the execution of the charter must be resolved directly with the Owner under the jurisdiction applicable to the Charter Agreement. Personal data will be processed by OK MOBILITY ESPAÑA S.L.U. to manage the booking and will be transferred to the Owner exclusively for the provision of the service. Intellectual property
This site and all of its original content are the sole property of its owner and are, as such, fully protected by the appropriate international copyright and other intellectual property rights laws. All third party content belongs to their respective owners and their use and protection is governed by their respective terms and conditions of use.

TranslationsIn the event of any discrepancy, the Spanish version shall prevail.

Termination

We reserve ourselves the right to terminate your access to the site, without any advance notice.
